1. Scope
These General Terms and Conditions, together with the Park Rules, govern the legal relationship between Styrassic Park GmbH, as operator of Styrassic Park including its car park, and visitors and car park users.
By purchasing or using an admission ticket, season pass or voucher, and at the latest by entering Styrassic Park, these GTC and the Park Rules are deemed to have been agreed, to the extent permitted by law.
Adult companions and supervisors are obliged to inform the children and other persons requiring supervision whom they bring along or supervise about the park and safety rules relevant to them, and to ensure compliance with these rules within the scope of their statutory duty of supervision.
The GTC and Park Rules in force at any given time are published on the Styrassic Park website. For season passes already purchased, the conditions announced at the time of purchase shall in principle apply.
2. Conclusion of Contract and Admission Tickets
The contract is concluded upon full payment of the respective admission price or voucher price.
Day tickets entitle the person who uses the ticket at the access control system to use the park facilities during the period provided for this purpose. Season passes are personal and non-transferable.
Tickets must correspond to the correct category and to the intended day of visit or period of validity. Misuse, alteration or unauthorised copying is prohibited and may result in the ticket becoming invalid and admission being refused. Tickets and vouchers not purchased directly from Styrassic Park or from a sales partner authorised by Styrassic Park will only be accepted if they are genuine, valid and have not already been redeemed or blocked. Styrassic Park accepts no responsibility for the authenticity or validity of tickets and vouchers purchased from unauthorised third parties. Mandatory statutory claims remain unaffected.
If you wish to leave the park briefly and intend to re-enter, please clarify the procedure with the ticket office staff beforehand.
Discounts cannot be combined unless a promotion provides otherwise.
Voluntarily shortening your visit to the park, voluntarily not using individual attractions or offers, or subjectively not liking the park offering do not give rise to any claim to a reduction of the admission price. Mandatory statutory claims remain unaffected.
Rules on photo, video and social media recordings are governed exclusively by section 15 (Data Protection).
3. Season Passes
Season passes are valid exclusively for the person named on them and for the period of validity stated.
They must be carried on every visit and presented on request.
In the event of loss, a replacement pass can be issued against the applicable processing fee of € 19,00.
4. Online Shop
Tickets purchased online must be carried in a form that allows them to be read or scanned properly.
Visitors are responsible for ensuring that a ticket stored on their own mobile device can be displayed at the time of admission.
For leisure services booked for a specific day or period (in particular tickets tied to a specific date or time), there is no right of withdrawal for distance contracts pursuant to § 18 (1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG).
For tickets not tied to a specific date or time, and for value vouchers not valid for a specific point in time, any statutory right of withdrawal remains unaffected.
Tickets not tied to a specific day of visit are valid exclusively for the period of validity or season stated at the time of purchase. The respective period of validity is announced at the time of purchase and is shown on the ticket or booking confirmation.
5. Vouchers
Vouchers may be used to pay for Styrassic Park services in accordance with their respective conditions.
Vouchers cannot be exchanged for cash.
Value vouchers purchased for payment are subject to the conditions and periods of validity announced at the time of purchase. Statutory claims, in particular regarding the permissible period of validity and limitation periods, remain unaffected.
Free promotional or prize-draw vouchers are subject to the conditions and periods of validity stated on the voucher or in the respective promotion.
6. Visiting Styrassic Park
During the opening hours published at any given time, the admission ticket entitles the holder to use the park facilities included in the admission price as intended, in compliance with these GTC, the Park Rules, the safety regulations and any usage restrictions.
Individual additional attractions subject to a charge may be excluded from the admission price.
The park offering may be changed, extended or rebuilt at any time, or restricted for reasons of safety, maintenance, technical or operational requirements or weather conditions.
Styrassic Park is not an entirely artificial or uniformly level leisure area; substantial parts of it are located in natural or near-natural woodland, hillside and park terrain. This particular character is an integral part of a visit to the park.
Use of the uncovered Styrassic Park car park spaces provided for visitors is free of charge during your visit to the park. There is no entitlement to a particular parking space or to the availability of a parking space; parking spaces can only be reserved if this is expressly offered online.
7. Rights and Obligations of Styrassic Park
Styrassic Park takes the safety, maintenance and inspection measures that are reasonable under the statutory provisions and the specific circumstances. However, this does not constitute a guarantee that natural or near-natural woodland and park terrain will be completely level, free of obstacles, dry, lit or free from natural changes at all times.
Individual areas, paths or attractions may be closed or restricted at any time, in particular due to maintenance, technical faults, visitor numbers, weather, force majeure or for safety reasons.
Temporary restrictions of individual offers do not in principle give rise to any claims for compensation or refund, provided that the essential park offering remains available and no mandatory statutory claims dictate otherwise.
In the event of sudden natural or weather events, it cannot be guaranteed that every visitor in the extensive grounds will be personally and directly reached, warned, searched for, collected or escorted out of the area concerned.
In particular, there is no obligation to send staff into an area if entering it would pose a significant risk to the life or health of the staff themselves due to a storm, thunderstorm or other acute danger that has already occurred.
The statutory obligations of the operator and mandatory statutory liability provisions remain unaffected. In particular, liability for personal injury, for damage caused by gross negligence or intent, and for breach of the operator’s duty to ensure safety (Verkehrssicherungspflicht) is neither excluded nor limited by these conditions.
Supervision: The mere presence of staff does not mean that Styrassic Park assumes general supervision of children or other persons requiring care. Supervision remains the responsibility of parents, legal guardians or other companions or supervisors, unless Styrassic Park has expressly assumed care or supervision for a specific offer.
Reporting damage: Accidents, injuries, damage and recognisable particular hazards must be reported to Styrassic Park staff as promptly as possible, insofar as this can reasonably be expected of the person concerned. This is intended in particular to enable rapid assistance, the securing of evidence and, where applicable, the removal of a source of danger.
8. Rights and Obligations of Visitors to Styrassic Park
8.1 Personal responsibility and natural terrain
Every visitor is obliged to move around the entire park responsibly, attentively and in a manner appropriate to the respective circumstances.
Substantial parts of Styrassic Park consist of natural or near-natural woodland, hillside and park terrain. Visitors must therefore expect conditions typical of such terrain, both on and beside visitor paths. These include in particular uneven ground, downhill and uphill slopes, roots, protruding roots and tree stumps, stones, branches, leaves, needles, soil, gravel, mud, puddles and other natural ground and terrain conditions.
Not all paths are smooth, level, paved, lit or barrier-free. Footwear, walking speed, attentiveness and behaviour must be adapted to these conditions.
Despite appropriate safety and inspection measures, a typical residual risk remains in natural, woodland and leisure terrain of this kind. Every visitor bears this typical residual risk, which cannot be completely avoided despite appropriate care, on their own responsibility within the framework of the statutory provisions.
8.2 Weather, storms, thunderstorms, black ice and darkness
Weather and visibility conditions can change considerably at short notice, sometimes within a few minutes, particularly in the event of storms, thunderstorms, heavy rain, hail, snow, frost, ice, black ice, fog or darkness.
Entering and remaining in the grounds when weather, natural or visibility hazards are recognisable or arise suddenly is at your own responsibility and risk with regard to the risks typically associated with them, which cannot be completely avoided despite appropriate care.
Every adult visitor must observe the weather, visibility and terrain conditions themselves and adapt their behaviour accordingly. In the event of a sudden storm, thunderstorm or any other recognisable immediate natural hazard, every visitor is obliged to take without delay the measures required under the specific circumstances to protect themselves and the children they are supervising.
Visitors may not rely, particularly in the event of sudden weather hazards, on every individual visitor being personally reached, warned, searched for, collected or
escorted by a member of staff in good time. This applies all the more if a member of staff could only enter the area concerned at considerable risk to themselves due to the weather situation that has already arisen.
In the dark, visitors must use a sufficient light source of their own when moving in an area that is not adequately lit or when taking part in an event for which a personal light source is required.
In wet conditions, snow, frost, ice or black ice, an increased risk of slipping must be expected and movement adjusted accordingly. Announced closures, warnings or safety instructions must be followed immediately.
8.3 Paths, signage and prohibited areas
Visitors must keep to the designated or approved visitor paths and observe the signage in place.
Alternative routes outside the fenced or expressly approved visitor area must not be used.
Leaving the designated visitor area without authorisation and entering woodland, embankments, operational, technical, forestry or other areas not approved for visitors is prohibited.
Barriers, fences, gates, chains and other access restrictions must not be climbed over, bypassed, opened or removed.
Where the continuation of a circular path or route is signposted at a fork, visitors must in principle follow this signage, unless a different approved route is expressly chosen by the guide as part of a guided event.
Anyone who, contrary to these provisions, uses an area that is not approved or a prohibited route is in breach of the Park Rules. In the event of damage, such behaviour may be taken into account as own fault or contributory negligence in accordance with the statutory provisions.
8.4 Guided events and night walks
Participants in guided tours, night walks and other guided events must in principle stay with the group and follow the instructions of the respective guide.
Anyone who wishes to leave the group, stay behind or take a different path must, if possible, inform the guide beforehand.
Anyone who loses direct contact with the group must exercise particular personal responsibility and caution and follow the regular signage and route markings.
On night walks, because of the darkness, a suitable torch or a sufficiently functional torch function on a mobile phone must be carried and used.
Taking part in a night walk typically involves walking along park and woodland paths in the dark. Every participant must therefore adapt their walking style and attentiveness to the restricted visibility and the natural terrain.
8.5 Children and supervision
Parents, legal guardians and other companions or supervisors are responsible for ensuring that the children in their care are supervised in a manner appropriate to their age and development.
In particular, they must ensure that children do not leave the designated visitor areas on their own, do not enter woodland or terrain areas that are closed off or not approved, and observe the safety, usage and conduct rules.
At playgrounds and attractions, companions must observe the respective age, height, weight and other usage restrictions.
Any further liability of parents or other supervisors is governed by the statutory provisions.
8.6 Smoking and fire ban
Smoking is strictly prohibited throughout Styrassic Park. This applies in particular on all paths, in woodland and natural areas, at attractions, on and in the immediate vicinity of playgrounds and in all other visitor areas.
Smoking is only permitted in the expressly marked smoking areas. Outside these smoking areas, lighting or discarding cigarettes, cigars or other tobacco products is also prohibited.
In the event of a particular risk of fire or forest fire, the marked smoking areas may also be temporarily closed.
8.7 General personal responsibility and contributory negligence
Every visitor must take note of recognisable hazards and assess their personal abilities, physical condition and behaviour on their own responsibility, as well as draw attention to any misuse or report it to the management.
Disregarding signposts, barriers, smoking bans, safety information, usage rules or instructions, entering areas that are not approved without authorisation, careless behaviour in the face of natural or weather hazards, or failing to use a necessary light source as the situation requires may, in the event of damage, be taken into account as own fault or contributory negligence in accordance with the statutory provisions.
The same applies if a participant moves a considerable distance away from a guided group without notice and thereby loses direct guidance from, or orientation with, the group.
8.8 Conduct, house rules and expulsion from the park
Visitors are obliged to comply with these GTC, the Park Rules, safety and usage rules and the legitimate instructions of staff.
If these rules are disregarded, Styrassic Park is entitled to exclude visitors from remaining in the park and to expel them from the grounds. In the case of serious or safety-related violations, expulsion from the park may take place without prior warning. This applies in particular to:
– smoking outside marked smoking areas,
– entering closed or non-approved areas,
– leaving the permitted visitor area via non-approved routes,
– bypassing or climbing over barriers,
– wilful disregard of safety-related instructions,
– endangering other visitors or staff,
– damaging facilities, attractions, plants or equipment,
– aggressive, threatening or grossly disruptive behaviour.
In such cases, Styrassic Park may also impose a temporary or permanent ban from the premises. If a visitor is expelled from the park due to a serious or safety-related breach of these GTC, the Park Rules or legitimate safety and conduct instructions for which the visitor is responsible, there is in principle no entitlement to a full or partial refund of the admission price. Mandatory statutory claims remain unaffected.
9. Opening Hours
The applicable season dates and opening hours are announced on the websites and at the designated places.
Styrassic Park may change opening hours or access to individual areas for operational, technical, safety or weather-related reasons.
Last admission to Styrassic Park is up to one hour before the announced closing time.
10. Dogs
Dog owners are obliged to comply with all statutory and official regulations applicable to bringing and keeping dogs. Liability for damage caused by the dog is governed by the statutory provisions. Until further notice, dogs may be brought along in accordance with the published rules.
They must always be kept under control in such a way that other visitors, especially children, are neither endangered nor significantly disturbed.
Dogs must be kept on a lead throughout the park. Dogs over 8 kg must also wear a suitable muzzle.
Dog owners are responsible for supervising their dog and for cleaning up after it.
In the event of violations, the owner and the dog may be expelled from the park or hotel areas.
11. Code of Ethics
Styrassic Park is intended to be a pleasant and safe place to enjoy, especially for families and children.
Quarrels, insults, threats, aggressive behaviour, bullying, discriminatory behaviour and significant disturbance of other guests or staff will not be tolerated.
In the case of correspondingly serious behaviour, the park management may expel persons from the park or premises without prior warning.
12. Lost Property
Found items can be handed in at the ticket office during opening hours and, if available, collected there.
Items not collected within the designated period are dealt with in accordance with statutory or organisational requirements or forwarded to the competent authority.
13. Severability Clause
Should any individual provision of these GTC or the Park Rules be or become wholly or partly invalid or unenforceable, the validity of the remaining provisions shall in principle remain unaffected. With regard to consumers, the legal consequences of invalidity are determined by the statutory provisions; a reduction of an invalid clause to the extent still permissible (geltungserhaltende Reduktion) to the detriment of the consumer is not agreed.
14. Choice of Law and Place of Jurisdiction
Austrian law applies unless mandatory law provides otherwise. For consumers, the statutory places of jurisdiction apply. No agreement on jurisdiction deviating from these to the detriment of a consumer is made. For entrepreneurs, the court with subject-matter jurisdiction for 8344 Bad Gleichenberg (Bezirksgericht Feldbach, Feldbach District Court) may – to the extent permitted by law – be agreed as the place of jurisdiction.
With regard to consumers, the mandatory consumer protection provisions of the state whose protection may not be withdrawn from the consumer by a choice of law under the applicable statutory provisions remain unaffected.
Insofar as these GTC apply to contracts with entrepreneurs, the place of performance is Bad Gleichenberg.
The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded, insofar as it would apply to the respective contractual relationship at all and its exclusion is permitted by law.
15. Data Protection, Photo and Video Recordings, Newsletter
Personal data are processed in accordance with the Privacy Policy and the applicable data protection provisions.
Merely paying for an admission ticket or entering the park does not automatically constitute unrestricted consent to the use for advertising purposes of photo or video recordings in which a person or their children can be individually identified.
Photo and video recordings for advertising or publication purposes are made on a permissible legal basis; where consent is required, it will be obtained separately.
Where video surveillance is operated on the park grounds, this is done on the basis of the data protection provisions and is marked accordingly.
Likewise, subscription to the newsletter does not take place automatically by providing an email address when purchasing a ticket, but in accordance with the statutory requirements for electronic direct marketing.
