3.3. Relevant legal bases

Unless the legal basis is stated in the privacy policy, the following applies: the legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 GDPR, the legal basis for processing to provide our services and carry out contractual measures as well as to respond to enquiries is Art. 6(1)(b) GDPR, the legal basis for processing to comply with our legal obligations is Art. 6(1)(c) GDPR, and the legal basis for processing to safeguard our legitimate interests is Art. 6(1)(f) GDPR. 3.4. Security measures
In accordance with Art. 32 GDPR, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing, as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, we implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk.
These measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access to, input, disclosure, securing the availability and separation of the data. Furthermore, we have established procedures that ensure the exercise of data subjects’ rights, the erasure of data and responses to threats to the data. In addition, we take the protection of personal data into account as early as the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by default (Art. 25 GDPR).
3.5. Terms used
“Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
“Processing” means any operation or set of operations which is performed on personal data, whether or not by automated means. The term is broad and covers practically any handling of data.
“Pseudonymisation” means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.
“Profiling” means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

4. Transfer and disclosure of data
Within the framework of the applicable data protection laws, Styrassic Park may pass on customer, guest and partner data to third parties who process this personal data for purposes consistent with the purpose of the data processing by Styrassic Park or for their own purposes.
Styrassic Park may pass on customer data, guest data and partner data to the following persons and organisations, who process this data for their own purposes or on behalf of Styrassic Park:
- Service providers within and outside Styrassic Park, including processors.
- Local, national and international government authorities, where ordered by an authority.
- The general public, including visitors to Styrassic Park websites and social media.
- Persons or companies that acquire or wish to buy a business unit, company or share in Styrassic Park.
- Parties to potential or actual court proceedings.
- Other companies that are part of the Styrassic Park Group.
Styrassic Park may disclose customer, guest and partner data within Styrassic Park and to third parties in any part of the world. If data is disclosed in countries that do not provide adequate protection, Styrassic Park will ensure the protection of the data by means of appropriate contractual safeguards, binding corporate rules and Privacy Shield frameworks. Customers, guests and partners can obtain copies of these safeguards, and Styrassic Park reserves the right to redact them for reasons of confidentiality.
4.1. Cooperation with processors and third parties
If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transfer it to them or otherwise grant them access to the data, this is only done on the basis of a legal permission (e.g. if a transfer of the data to third parties, such as payment service providers, is necessary for the performance of a contract pursuant to Art. 6(1)(b) GDPR), if you have given your consent, if a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).
If we commission third parties to process data on the basis of a so-called “data processing agreement”, this is done on the basis of Art. 28 GDPR.
4.2.Transfers to third countries
If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or if this occurs in the context of using third-party services or disclosing or transferring data to third parties, this only takes place if it is done to fulfil our (pre-)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or have the data processed in a third country only if the special requirements of Art. 44 et seq. GDPR are met. This means, for example, that the processing takes place on the basis of special guarantees, such as the officially recognised determination of a level of data protection equivalent to that of the EU (e.g. for the USA through the “Privacy Shield”), or compliance with officially recognised special contractual obligations (so-called “standard contractual clauses”).
5. Data storage and erasure of data
5.1. Data storage
Styrassic Park stores personal data only for as long as is necessary for the purpose for which it is processed. However, personal data may be processed for a longer period due to contractual, legal or other obligations or due to an overriding interest (e.g. in the event of claims). Deviating provisions on anonymisation or pseudonymisation remain reserved.
For customer and partner data associated with a contract, Styrassic Park stores personal data for as long as the contractual relationship exists and for a further 10 years after its termination, unless there is a shorter or longer legal obligation or a legitimate reason to store or erase the data.
Operational data containing customer, guest or partner data is generally stored for 3 to 12 months.
5.2. Erasure of data
The data processed by us is erased or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated within this privacy policy, the data stored by us is erased as soon as it is no longer required for its intended purpose and there are no statutory retention obligations preventing its erasure. If the data is not erased because it is required for other, legally permissible purposes, its processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.
In accordance with legal requirements in Germany, data is retained in particular for 10 years pursuant to §§ 147(1) of the German Fiscal Code (AO), 257(1) nos. 1 and 4, (4) of the German Commercial Code (HGB) (books, records, management reports, accounting vouchers, commercial books, documents relevant for taxation, etc.) and for 6 years pursuant to § 257(1) nos. 2 and 3, (4) HGB (commercial letters).
In accordance with legal requirements in Austria, data is retained in particular for 7 years pursuant to § 132(1) of the Austrian Federal Fiscal Code (BAO) (accounting documents, vouchers/invoices, accounts, receipts, business papers, statements of income and expenditure, etc.), for 22 years in connection with real estate and for 10 years for documents relating to electronically supplied services, telecommunications, radio and television services provided to non-business customers in EU member states and for which the Mini One-Stop Shop (MOSS) is used.
6. Cookies
“Cookies” are small files that are stored on users’ computers. Various pieces of information can be stored within cookies. A cookie is primarily used to store information about a user (or the device on which the cookie is stored) during or after their visit to an online service. Temporary cookies, or “session cookies” or “transient cookies”, are cookies that are deleted after a user leaves an online service and closes their browser. Such a cookie may store, for example, the contents of a shopping basket in an online shop or a login status. Cookies that remain stored even after the browser has been closed are referred to as “permanent” or “persistent”. For example, the login status can be saved if users visit the service again after several days. Likewise, such a cookie can store users’ interests, which are used for reach measurement or marketing purposes. “Third-party cookies” are cookies offered by providers other than the controller who operates the online service (otherwise, if they are only the controller’s own cookies, they are referred to as “first-party cookies”).
We may use temporary and permanent cookies and explain this within our privacy policy.
Styrassic Park uses cookies on its website, a widely used technology in which an identifier is assigned to a user’s browser. These cookies make it possible to establish a stable connection between the user and the server, for example to ensure that the contents of a shopping basket are not lost. There are both temporary cookies, which are automatically deleted when the website is closed, and permanent cookies, which are only deleted after a certain period of time. The use of cookies can improve the functionality of the website, e.g. by saving settings such as language settings or an automatic login. However, if the user blocks or deletes the use of cookies in their browser, this may impair the functionality of the website.
In accordance with applicable law, Styrassic Park may include tracking in its newsletters and marketing communications that makes it possible to recognise whether the email has been opened or the images in the email have been downloaded. However, the recipient has the option of blocking this tracking in their email settings. By receiving newsletters or other marketing emails, however, the recipient agrees in any case to the use of this technology.
When Styrassic Park places third-party advertising (e.g. banners) on its own website or on a third-party website, companies that specialise in the use of such advertising may set cookies. Styrassic Park does not disclose any personal information to these companies. Instead, these companies only set a permanent cookie on users’ devices in order to recognise them, and act exclusively in the interest of Styrassic Park. This enables Styrassic Park to display personalised advertising on external third-party websites (e.g. in connection with products in which a user has shown interest). Styrassic Park does not pass on any personal data to the operators of external websites.
Styrassic Park may use services such as Google Analytics on its own website to measure and analyse the use of this site. These services are provided by third-party companies that may be based anywhere in the world. These providers use permanent cookies, and Styrassic Park does not pass on any personal data to them. However, the service provider may monitor the user’s use of the website and combine this data with other websites that it monitors and that the user has visited. The data may be used by the service provider for its own purposes (e.g. for advertising). In this case, the personal data must comply with the data protection laws and policies of the service provider. The service provider provides Styrassic Park with data on the use of its own website.
Styrassic Park may also use social media plugins such as Facebook, Twitter, YouTube, Google+, Pinterest or Instagram on its website. By default, these plugins are deactivated, but the user can activate them if required. If the user activates them, a direct connection may be established between the user and the social media providers during their visit to the website. This enables the providers to track and analyse the user’s visit. The subsequent processing of personal data is the responsibility of the respective social media providers in accordance with their data protection provisions and personality rights laws as well as the privacy policies on their websites (e.g. www.facebook.com, www.twitter.com, www.youtube.com, www.google.com, www.instagram.com). Information about the cookies used by Styrassic Park and how to manage cookie settings can be found on the website.
6.1.1. Business-related processing
In addition, we process
– contract data (e.g. subject matter of the contract, term, customer category).
– payment data (e.g. bank details, payment history)
of our customers, prospective customers and business partners for the purpose of providing contractual services, service and customer care, marketing, advertising and market research.
6.1.2. Administration, financial accounting, office organisation, contact management
We process data in the context of administrative tasks as well as the organisation of our business, financial accounting and compliance with legal obligations, such as archiving. In doing so, we process the same data that we process in the course of providing our contractual services. The legal bases for processing are Art. 6(1)(c) GDPR and Art. 6(1)(f) GDPR. Customers, prospective customers, business partners and website visitors are affected by the processing. The purpose of and our interest in the processing lies in administration, financial accounting, office organisation and the archiving of data, i.e. tasks that serve to maintain our business activities, perform our tasks and provide our services. The erasure of data with regard to contractual services and contractual communication corresponds to the information provided for these processing activities.
In this context, we disclose or transfer data to the tax authorities, advisers such as tax advisers or auditors, as well as other fee collection bodies and payment service providers.
Furthermore, on the basis of our business interests, we store information on suppliers, event organisers and other business partners, e.g. for the purpose of contacting them later. As a rule, we store this predominantly company-related data permanently.
6.1.3. Business analyses and market research
In order to operate our business economically and to identify market trends and the wishes of contractual partners and users, we analyse the data available to us on business transactions, contracts, enquiries, etc. In doing so, we process master data, communication data, contract data, payment data, usage data and metadata on the basis of Art. 6(1)(f) GDPR, whereby the data subjects include contractual partners, prospective customers, customers, visitors and users of our online services.
The analyses are carried out for the purpose of business evaluations, marketing and market research. In doing so, we may take into account the profiles of registered users with information, e.g. on the services they have used. The analyses help us to increase user-friendliness, optimise our offering and improve business efficiency. The analyses are used solely by us and are not disclosed externally, unless they are anonymous analyses with aggregated values.
Insofar as these analyses or profiles are personal, they are deleted or anonymised when users terminate their contract, otherwise after two years from the conclusion of the contract. Otherwise, overall business analyses and general trend assessments are prepared anonymously wherever possible.
6.1.4. Contacting us
When you contact us (e.g. via contact form, email, telephone or social media), the user’s details are processed for the purpose of handling the contact enquiry and its processing in accordance with Art. 6(1)(b) (within the framework of contractual/pre-contractual relationships) and Art. 6(1)(f) (other enquiries) GDPR. Users’ details may be stored in a customer relationship management system (“CRM system”) or a comparable enquiry management system.
We delete enquiries when they are no longer required. We review whether they are still required every two years; statutory archiving obligations also apply.
6.1.5. Hosting and sending of emails
The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, email sending, security services and technical maintenance services, which we use for the purpose of operating the online services of this business.
In this context, we or our hosting provider process master data, contact data, content data, contract data, usage data, meta and communication data of customers, prospective customers and visitors to these online services on the basis of our legitimate interests in the efficient and secure provision of these online services pursuant to Art. 6(1)(f) GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing agreement).
6.1.6. Collection of access data and log files
On the basis of our legitimate interests within the meaning of Art. 6(1)(f) GDPR, we or our hosting provider collect data on every access to the server on which this service is located (so-called server log files). The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider.
For security reasons (e.g. to investigate acts of misuse or fraud), log file information is stored for a maximum of 7 days and then deleted. Data whose further retention is necessary for evidential purposes is excluded from deletion until the respective incident has been finally clarified.
6.2. Real Cookie Banner
Terms: https://devowl.io/de/wordpress-real-cookie-banner/
6.3. Google
6.3.1. Google Tag Manager
Google Tag Manager is a solution that allows us to manage so-called website tags via an interface (and thus, for example, integrate Google Analytics and other Google marketing services into our online services). The Tag Manager itself, which implements the tags, does not process any personal data of users. With regard to the processing of users’ personal data, please refer to the following information on the Google services. Usage policy: https://www.google.com/intl/de/tagmanager/use-policy.html
6.3.2. Google Analytics
On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR), we use Google Analytics, a web analytics service provided by Google LLC (“Google”). Google uses cookies. The information generated by the cookie about users’ use of the online offering is generally transmitted to a Google server in the USA and stored there.
Google is certified under the Privacy Shield agreement and thereby provides a guarantee that it will comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
Google will use this information on our behalf to evaluate users’ use of our online offering, to compile reports on activities within this online offering and to provide us with further services relating to the use of this online offering and of the internet. Pseudonymous user profiles may be created from the processed data in this context.
We only use Google Analytics with IP anonymisation activated. This means that users’ IP addresses are truncated by Google within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there.
The IP address transmitted by the user’s browser is not merged with other Google data. Users can prevent cookies from being stored by adjusting their browser software settings accordingly; users can also prevent Google from collecting the data generated by the cookie and relating to their use of the online offering, and from processing this data, by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de
Further information on Google’s use of data and on settings and objection options can be found in Google’s privacy policy (https://policies.google.com/technologies/ads) and in Google’s settings for the display of advertisements (https://adssettings.google.com/authenticated).
Users’ personal data is deleted or anonymised after 14 months.
6.3.3. Creating target audiences with Google Analytics
We use Google Analytics to display advertisements placed by Google’s advertising services and those of its partners only to users who have shown an interest in our online offering or who exhibit certain characteristics (e.g. interests in particular topics or products, determined on the basis of the websites visited) that we transmit to Google (so-called “remarketing audiences” or “Google Analytics audiences”). With the help of remarketing audiences, we also want to ensure that our advertisements correspond to users’ potential interests.
6.3.4. Google AdWords and conversion measurement
On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR), we use the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).
Google is certified under the Privacy Shield agreement and thereby provides a guarantee that it will comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
We use Google’s online marketing procedure “AdWords” to place advertisements in the Google advertising network (e.g. in search results, in videos, on websites, etc.) so that they are displayed to users who are presumed to have an interest in the advertisements. This allows us to display advertisements for and within our online offering in a more targeted way, so that users are only shown advertisements that potentially match their interests. If, for example, a user is shown advertisements for products in which they have shown interest on other online offerings, this is referred to as “remarketing”. For these purposes, when our website and other websites on which the Google advertising network is active are accessed, Google directly executes a Google code and so-called (re)marketing tags (invisible graphics or code, also referred to as “web beacons”) are integrated into the website. With their help, an individual cookie, i.e. a small file, is stored on the user’s device (comparable technologies may also be used instead of cookies). This file records which websites the user has visited, which content they are interested in and which offers the user has clicked on, as well as technical information about the browser and operating system, referring websites, time of visit and further information on the use of the online offering.
We also receive an individual “conversion cookie”. The information obtained with the help of the cookie is used by Google to create conversion statistics for us. However, we only learn the anonymous total number of users who clicked on our advertisement and were forwarded to a page bearing a conversion tracking tag. We do not, however, receive any information that can be used to identify users personally.
Users’ data is processed pseudonymously within the Google advertising network. This means that Google does not, for example, store and process users’ names or e-mail addresses, but processes the relevant data on a cookie basis within pseudonymous user profiles. In other words, from Google’s perspective, the advertisements are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. The information collected about users is transmitted to Google and stored on Google’s servers in the USA.

6.4. Online presence and social media
6.4.1. Online presences in social media
We maintain online presences within social networks and platforms in order to communicate with the customers, prospective customers and users active there and to inform them about our services.
We would like to point out that users’ data may be processed outside the European Union. This may result in risks for users because, for example, it could make it more difficult to enforce users’ rights. With regard to US providers certified under the Privacy Shield, we would like to point out that they thereby undertake to comply with EU data protection standards.
Furthermore, users’ data is generally processed for market research and advertising purposes. For example, usage profiles can be created from users’ usage behaviour and the resulting interests. These usage profiles can in turn be used, for example, to place advertisements within and outside the platforms that presumably correspond to users’ interests. For these purposes, cookies are generally stored on users’ computers, in which users’ usage behaviour and interests are stored. Furthermore, data may also be stored in the usage profiles independently of the devices used by the users (in particular if the users are members of the respective platforms and are logged in to them).
Users’ personal data is processed on the basis of our legitimate interests in informing and communicating with users effectively in accordance with Art. 6(1)(f) GDPR. If users are asked by the respective providers for their consent to data processing (i.e. they declare their agreement, e.g. by ticking a checkbox or confirming a button), the legal basis for the processing is Art. 6(1)(a) and Art. 7 GDPR.
For a detailed description of the respective processing operations and the options to object (opt-out), please refer to the providers’ information linked below.
Also in the case of requests for information and the assertion of users’ rights, we would like to point out that these can be asserted most effectively with the providers. Only the providers have access to users’ data and can take appropriate measures and provide information directly. Should you nevertheless need help, you can contact us.

6.4.2. Integration of third-party services and content
Within our online offering, on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR), we use content or service offerings from third-party providers in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as “content”).
This always requires that the third-party providers of this content perceive users’ IP addresses, as without the IP address they would not be able to send the content to their browsers. The IP address is therefore necessary for displaying this content. We endeavour to use only content whose respective providers use the IP address solely for delivering the content. Third-party providers may also use so-called “pixel tags” (invisible graphics, also referred to as “web beacons”) for statistical or marketing purposes. The “pixel tags” can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on users’ devices and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and further information on the use of our online offering, and may also be linked to such information from other sources.
6.4.3. YouTube
We integrate the videos of the “YouTube” platform of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Privacy policy: https://www.google.com/policies/privacy/, opt-out: https://adssettings.google.com/authenticated
6.4.4. Twitter
Functions and content of the Twitter service, offered by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA, may be integrated within our online offering. This may include, for example, content such as images, videos or texts and buttons with which users can share content from this online offering within Twitter.
If users are members of the Twitter platform, Twitter can assign the access of the above-mentioned content and functions to the users’ profiles there. Twitter is certified under the Privacy Shield agreement and thereby provides a guarantee that it will comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000TORzAAO&status=Active). Privacy policy: https://twitter.com/de/privacy, opt-out: https://twitter.com/personalization
6.4.5. Instagram
Functions and content of the Instagram service, offered by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA, may be integrated within our online offering. This may include, for example, content such as images, videos or texts and buttons with which users can share content from this online offering within Instagram. If users are members of the Instagram platform, Instagram can assign the access of the above-mentioned content and functions to the users’ profiles there. Instagram’s privacy policy: https://instagram.com/about/legal/privacy/
6.4.6. Pinterest
Functions and content of the Pinterest service, offered by Pinterest Inc., 635 High Street, Palo Alto, CA, 94301, USA, may be integrated within our online offering. This may include, for example, content such as images, videos or texts and buttons with which users can share content from this online offering within Pinterest. If users are members of the Pinterest platform, Pinterest can assign the access of the above-mentioned content and functions to the users’ profiles there. Pinterest’s privacy policy: https://about.pinterest.com/de/privacy-policy
6.4.7. Use of Facebook social plugins
On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6(1)(f) GDPR), we use social plugins (“plugins”) of the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”).
This may include, for example, content such as images, videos or texts and buttons with which users can share content from this online offering within Facebook. The list and appearance of the Facebook social plugins can be viewed here: https://developers.facebook.com/docs/plugins/
Facebook is certified under the Privacy Shield agreement and thereby provides a guarantee that it will comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).
When a user accesses a function of this online offering that contains such a plugin, their device establishes a direct connection with Facebook’s servers. The content of the plugin is transmitted by Facebook directly to the user’s device and integrated by it into the online offering. User profiles may be created from the processed data in this context. We therefore have no influence on the scope of the data that Facebook collects with the help of this plugin and therefore inform users according to our state of knowledge.
By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the online offering. If the user is logged in to Facebook, Facebook can assign the visit to their Facebook account. If users interact with the plugins, for example by clicking the Like button or posting a comment, the corresponding information is transmitted from your device directly to Facebook and stored there. If a user is not a member of Facebook, it is still possible that Facebook will learn and store their IP address. According to Facebook, only an anonymised IP address is stored in Germany.
The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as users’ related rights and setting options for protecting their privacy, can be found in Facebook’s privacy notice: https://www.facebook.com/about/privacy/
If a user is a Facebook member and does not want Facebook to collect data about them via this online offering and link it to their member data stored on Facebook, they must log out of Facebook and delete their cookies before using our online offering. Further settings and objections to the use of data for advertising purposes are possible within the Facebook profile settings: https://www.facebook.com/settings?tab=ads or via the US site https://www.aboutads.info/choices/ or the EU site https://www.youronlinechoices.com/. The settings are platform-independent, i.e. they are applied to all devices, such as desktop computers or mobile devices.

7. Rights of customers, guests and partners
Data subjects, including customers, guests and partners, have the right to obtain information from Styrassic Park as to whether data concerning them is being processed. They may also request the rectification, destruction or restriction of their personal data or object to the processing of this data. If the processing is based on consent, the data subject may withdraw this consent at any time. In EU and EEA countries, data subjects have the right in certain cases to request data generated through the use of online services in a structured, commonly used, machine-readable format that enables further use and transfer. For such requests, please contact the contact points (see point 1 above). Styrassic Park reserves the right to restrict the rights of data subjects in accordance with applicable law and, for example, not to disclose extensive information or not to delete data.
If Styrassic Park has to make an automated decision that has legal effects on a person or affects them in any way, this person has the right to contact a controller at Styrassic Park and to request a review of the decision or the reasons for the decision from them. In this case, the data subject may no longer be able to use certain automated services, of which they will be informed separately.
The data subject may also lodge a complaint with the competent data protection authority. For Styrassic Park, this is the Austrian Data Protection Authority (Datenschutzbehörde) (https://www.dsb.gv.at/ueber-die-website/kontakt.html).
8. Changes to this privacy notice
Styrassic Park reserves the right to change this privacy notice without prior notice. The current version on the Styrassic Park website is always deemed to be the latest. If the privacy notice forms part of a contract with customers or partners, Styrassic Park will inform them of any changes by e-mail or another appropriate method. If no objections are raised within 30 days, the changes are deemed to have been accepted. In the event of an objection, Styrassic Park reserves the right to terminate the contract without notice.
9. Special provisions
The rules in this section override any general provisions in Part I that concern specific activities of Styrassic Park. In the event of conflicts, these provisions take precedence.
9.1. Online shops
In online shops, credit assessments of customers may be carried out in order to offer purchase on account. This assessment is based on information from an external credit agency, which Styrassic Park uses to obtain a credit rating for the customer. This rating is calculated using a confidential formula based on data such as payment history, debt and insolvency history and possible restrictions on legal capacity. If the rating is below a certain threshold, purchase on account is not offered. Customers who do not agree with this decision can contact the contact person named in the imprint of the online shop website. Styrassic Park’s online shops may make a purchase decision automatically, but Styrassic Park does not regard this as an automated decision within the meaning of Article 22 GDPR. Customers who do not wish to conclude a contract automatically can instead purchase the products and services on site in Styrassic Park’s shops.
9.2. Partners, including wholesalers, retailers, specialist dealers, customer service providers, etc.
As already mentioned, Styrassic Park collects customer, partner and guest data directly and indirectly (for example by commissioning third parties such as Styrassic Park’s partners as processors). In such cases, Styrassic Park’s partners process the personal data on the instructions and on behalf of the company. These partners are bound by special data processing agreements that set out their responsibilities in order to safeguard the rights of customers, partners and guests and the protection of their personal data in accordance with applicable data protection laws.
9.3. Newsletters and banner advertising
Styrassic Park sends newsletters and other business communications to customers and partners in connection with its products and services. It reserves the right to send these without prior consent, insofar as permitted by applicable law. However, customers and business partners can refuse further newsletters or commercial communications at any time by managing their account on the relevant website or by using the link in each mailing. During a visit to the website, Styrassic Park may place personalised advertising. This advertising is based on the products previously viewed by the customer and is generated by cookies.
9.4. Newsletter
With the following information, we inform you about the content of our newsletter as well as the registration, dispatch and statistical evaluation procedures and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.
Content of the newsletter: We send newsletters, e-mails and other electronic notifications containing advertising information (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. If the contents of the newsletter are specifically described when registering for it, they are decisive for the users’ consent. Otherwise, our newsletters contain information about our products and accompanying information (e.g. safety notices), offers, promotions and our company.
Double opt-in and logging: Registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registering, you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that nobody can register with someone else’s e-mail address. Newsletter registrations are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored with the mailing service provider are also logged.
Registration data: To register for the newsletter, it is sufficient to provide your e-mail address. Optionally, we ask you to provide a name so that we can address you personally in the newsletter.
The dispatch of the newsletter and the associated performance measurement are based on the consent of the recipients in accordance with Art. 6(1)(a) and Art. 7 GDPR in conjunction with § 107(2) of the Austrian Telecommunications Act (TKG) or, if consent is not required, on the basis of our legitimate interests in direct marketing in accordance with Art. 6(1)(f) GDPR in conjunction with § 107(2) and (3) TKG.
The registration procedure is logged on the basis of our legitimate interests in accordance with Art. 6(1)(f) GDPR. Our interest lies in using a user-friendly and secure newsletter system that both serves our business interests and meets users’ expectations, and also allows us to prove consent.
Cancellation/withdrawal – You can cancel your subscription to our newsletter at any time, i.e. withdraw your consent. You will find a link to cancel the newsletter at the end of each newsletter. We may store unsubscribed e-mail addresses for up to three years on the basis of our legitimate interests before deleting them, in order to be able to prove consent previously given. The processing of this data is limited to the purpose of a possible defence against claims. An individual request for deletion is possible at any time, provided that the former existence of consent is confirmed at the same time.
9.4.1. Newsletter – mailing service provider
The newsletter is sent via the mailing service provider [currently open, as not yet commissioned: NAME, ADDRESS, COUNTRY]. You can view the mailing service provider’s privacy policy here: [LINK TO THE PRIVACY POLICY]. The mailing service provider is used on the basis of our legitimate interests in accordance with Art. 6(1)(f) GDPR and a data processing agreement in accordance with Art. 28(3) sentence 1 GDPR.
The mailing service provider may use the recipients’ data in pseudonymised form, i.e. without assignment to a user, to optimise or improve its own services, e.g. for the technical optimisation of the dispatch and presentation of the newsletters or for statistical purposes. However, the mailing service provider does not use the data of our newsletter recipients to write to them itself or to pass the data on to third parties.
9.4.2. Newsletter – performance measurement
The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from our server when the newsletter is opened or, if we use a mailing service provider, from its server. In the course of this retrieval, technical information such as information about the browser and your system, as well as your IP address and the time of retrieval, is initially collected.
This information is used for the technical improvement of the services on the basis of the technical data or the target groups and their reading behaviour on the basis of their retrieval locations (which can be determined with the help of the IP address) or access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor, if used, that of the mailing service provider to monitor individual users. Rather, the evaluations serve to help us recognise the reading habits of our users and to adapt our content to them or to send different content according to our users’ interests.
Unfortunately, it is not possible to withdraw consent to the performance measurement separately; in this case, the entire newsletter subscription must be cancelled.
9.5. Prize draws and other promotions
Data in connection with advertising measures or prize draws is processed by the local Styrassic Park company organising the prize draw and, where applicable, also by Styrassic Park Aktiengesellschaft. Other companies that are part of the Styrassic Park group may use this data for their own purposes in accordance with the provisions in Section I, point 3.
In the case of prize draws or other advertising measures, Styrassic Park collects the data of its participants in accordance with the rules and laws described in the previous section. The processing of this data serves the purposes stated in the respective provision.
- Conducting the competition;
- Contacting the winners;
- Publishing the winners’ contact details;
- Advertising featuring the winners on social media and
- Other advertising and marketing activities.
Participants in prize draws and other promotional activities can find more detailed information on the respective conditions of these activities in the special terms and conditions that apply to each published and organised prize draw or promotional activity.
9.6. Video surveillance
Styrassic Park monitors some areas of the company premises by means of video surveillance. The body responsible for the recorded personal data under the EU General Data Protection Regulation and other applicable data protection laws is the specified Styrassic Park entity. The processing of this data is necessary to ensure safety on the premises and to protect Styrassic Park’s property. Styrassic Park does not use this data for automated decisions or profiling. As a rule, this data is not stored for longer than necessary. In the case of special incidents that could potentially give rise to legal claims, it is retained until the limitation period expires. Styrassic Park may pass on personal data to service providers, authorities, other parties in legal proceedings or group companies, provided that this complies with data protection laws. To ensure adequate protection, appropriate contractual guarantees or binding internal rules are applied. Data subjects can request information about the processing of their data, have it rectified, deleted or restricted, and also object or request data portability. Anyone can also lodge a complaint with the competent data protection authority. If you have any questions or concerns regarding our privacy policy or the processing of your personal data, you can contact us.
